Contract and Waiver Agreement

Wanderlust Travel Consultants (“Organizer” / “Travel Company”) and the undersigned Participant(s) (“Traveler” or “you”) agree as follows.

1. Trip Details & Scope of Services


Destination: Iceland

Trip Dates: February 12–16/17, 2026


Inclusions: Accommodations; ground transportation; select guided tours & entrance fees as listed in the final itinerary; some meals (as specified); and group support from the Organizer.


Exclusions: Airfare (unless otherwise specified), optional excursions, meals not listed, personal expenses, travel insurance (see Section 7), visas/entry fees (if applicable), and any items not explicitly included.


Organizer reserves the right to adjust the route, schedule, lodging, guide, or suppliers as necessary for safety, logistics, or force majeure.

2. Payment Terms & Cancellation Policies


Deposit: $500 per person due at booking. Refundable until November 1, 2025.


Final Payment: Remaining balance due by January 10, 2026. Required to secure participation.


Failure to Pay Clause: If the Traveler fails to make the Final Payment by January 10, 2026, Wanderlust Travel Consultants reserves the right to automatically cancel the Traveler’s reservation without further notice. All payments made to date will be forfeited, and the reserved spot may be offered to another traveler. Reinstatement, if available, is at the Organizer’s sole discretion and may be subject to additional fees or increased trip costs.


Cancellation Schedule & Penalties (by Traveler)


• On or before November 30, 2025: Full refund minus the $500 deposit

• After January 11, 2026: No refund (final hotel payments are non-refundable) No-show / mid-trip withdrawal: No refund

3. Traveler Obligations & Representations


• Accurate Info: You agree to provide true and up-to-date personal, medical, and travel documentation information.

• Documents & Health: You are responsible for obtaining a valid passport, visas, vaccinations, and any required permits.

• Conduct: You agree to follow local laws and safety guidelines. Organizer may remove a Traveler (without refund) whose behavior endangers or disrupts the group.

• Fitness & Medical: You affirm you are physically and mentally fit to participate and will disclose relevant medical info in writing.

4. Assumption of Risk & Waiver of Liability


Travel in Iceland during winter may involve severe weather, icy terrain, remote environments, and limited medical access. In consideration of the services provided and permission to participate, you:


• Assume all risks (known and unknown), including injury, illness, delays, transportation issues force majeure, and supplier failures.

• Release and hold harmless Wanderlust Travel Consultants, its owners, employees, contractors, agents, and affiliates from any claims arising from participation, including negligence, to the fullest extent permitted by law. • Agree to indemnify the Released Parties from claims or damages caused by your actions or non-compliance.

• Consent to emergency medical treatment if necessary and accept financial responsibility for related costs.

• Acknowledge no guarantees are made regarding weather, itinerary outcomes, or experiences.

• Agree that if any provision is held invalid, the remainder remains enforceable.

5. Force Majeure & Unforeseen Events


Neither Party is liable for failures or delays caused by events beyond their control (e.g., natural disasters, war, strikes, pandemics, government regulations). Organizer may substitute arrangements or cancel with refunds of recoverable amounts (minus vendor penalties).

6. Changes by Organizer


Organizer may change itinerary, hotels, or vendors for operational or safety reasons. Such changes do not constitute breach. If a change materially reduces value, Traveler may withdraw (subject to cancellation terms) or accept revised arrangements.

7. Travel Insurance


Comprehensive travel insurance is required for all participants on this trip. Your policy must, at minimum, cover:


• Trip cancellation and interruption

• Medical emergencies abroad

• Emergency evacuation and repatriation

• Travel delays and lost baggage


You may purchase insurance through Wanderlust Travel Consultants or any reputable provider of your choice. Proof of coverage must be submitted no later than December 15, 2025.


Travelers who fail to provide proof by this date may have their reservation canceled without refund. Wanderlust Travel Consultants is not responsible for any costs, losses, or damages that would have been covered by a comprehensive travel insurance policy.

8. Dispute Resolution & Governing Law


This Agreement is governed by the laws of the State of New Jersey. Any disputes shall be resolved by binding arbitration in Camden County, New Jersey, unless otherwise agreed. The prevailing party may recover reasonable attorney’s fees and costs.

9. Photography / Media Release


You grant Wanderlust Travel Consultants permission to use photographs and videos of you during the trip for promotional purposes, unless you opt out in writing before departure.

10. Age and Minor Participation


Minimum Age. Travelers must be 18 years or older to participate unaccompanied. Travelers aged 16–17 may participate only if accompanied on the trip by their parent or legal guardian, who must sign all required forms and accept full responsibility for the minor at all times.


Definitions. A “Minor” is any traveler under 18 on the trip start date.


Supervision. Organizer is not in loco parentis and does not provide childcare or supervision. The Minor’s parent/guardian is solely responsible for the Minor’s conduct, safety, and compliance with itineraries and instructions.


Rooming. Minors must share a room with their parent/guardian unless otherwise approved in writing by Organizer.


Activity Eligibility. Participation in third-party activities is subject to the supplier’s age/height/weight/skill/medical rules. If a Minor is ineligible, no refund is guaranteed for the unused portion of that activity.


Documentation. Parent/guardian must provide all required consent documents, including (as applicable) a notarized Parental Consent to Travel, Medical Treatment Authorization, and any other documents required by carriers, border authorities, or suppliers. Failure to provide documents may result in denial of services without refund.

13. Acknowledgment & Signature


By signing, you acknowledge you’ve read and agree to this contract and waiver in full. You understand it is legally binding.
